Terms & Conditions — AD Background

Who we are
AD Background is provided by By ADs, For ADs LLC (“we,” “us”). Contact: Support@byadsforads.com and 1870 Burning Tree Dr., Decatur, GA 30032.
Relationship with Apple
If you obtained AD Background from Apple’s App Store, Apple’s Licensed Application End User License Agreement (EULA) applies. These Terms supplement that EULA. Where required by Apple’s policies, the EULA controls.
License
We grant you a limited, non-exclusive, non-transferable license to install and use AD Background on Apple-branded devices you own or control, solely for personal or internal business use. You may not copy, modify, reverse engineer, decompile, sell, rent, or exploit the app except as permitted by law.
Eligibility & acceptable use
You must be at least 16, or the applicable age of digital consent in your region, to use the app.
You are responsible for ensuring that you have the right, permission, authorization, or other lawful basis to enter, scan, process, sync, or share documents and information using AD Background.
You may not use the app to process or share content in violation of applicable law, contractual obligations, confidentiality requirements, or third-party rights. You are responsible for the content you provide to the app and for your use of information produced by the app.
User content & permissions
You retain ownership of the content you enter, import, or create in AD Background.
You authorize AD Background to process your content only as necessary to provide the features you choose to use. This may include processing information locally on your device and, if you enable iCloud sync or sharing, transmitting and storing app data through Apple CloudKit.
By ADs, For ADs LLC does not maintain its own server copies of your in-app content and does not use your content for advertising, profiling, or sale.
Document scanning & automated extraction
AD Background may allow you to scan documents and automatically identify and import relevant information.
Document scanning and automated extraction are provided as convenience tools. Automated text recognition and AI-assisted analysis may produce inaccurate, incomplete, duplicated, or incorrectly associated information.
You are responsible for reviewing and verifying extracted information against the original document before relying on it, sharing it, or using it for production, scheduling, staffing, payroll, compliance, or other purposes.
You are also responsible for ensuring that you are authorized to scan and process any document you provide to the app, including documents containing confidential information or personal information relating to other people.
Scanned document images are temporarily processed for the purpose of extracting information and are not intended to serve as document storage or archival copies. You should retain the original document separately if you need it for your records.

Privacy
We do not run ads or third-party trackers. Data is stored on your device and, if you enable sync/sharing, in youriCloud account via Apple’s CloudKit. We do not maintain our own copies of your content on our servers. See our Privacy Policy for details. Crash/diagnostics data, if enabled in iOS, is provided by Apple and may be de-identified.
CloudKit, iCloud & availability
Cloud features require a valid Apple ID and iCloud enabled. Service quality depends on Apple’s systems and your connectivity. If iCloud storage is full/disabled or Apple experiences outages, sync and sharing may fail or be delayed. Back up your data; we are not responsible for data loss.
Plans, in-app purchases & auto-renewal
- Free tier includes on-device features.
- Pro Monthly and Pro Annual unlock CloudKit sharing and other Pro features.
- Subscriptions are billed to your Apple ID and auto-renew unless canceled at least 24 hours before the end of the current period.
- Manage or cancel in Settings ▸ [your name] ▸ Subscriptions. Cancellation takes effect at the end of the current period.
- Trials/intro offers convert to paid unless canceled before they end.
- Price changes may occur; Apple will notify and handle consent per App Store rules.
- Refunds are handled by Apple; we don’t issue direct refunds.
No professional advice; accuracy & safety notice
AD Background is an organizational and collaboration tool. It does not provide legal, employment, labor, HR, payroll, safety, union, or regulatory advice and is not designed for safety-critical use.
Information entered manually or generated through document scanning, text recognition, Apple Intelligence, or other automated features may contain errors. You should independently verify important information before relying on it, particularly information relating to call times, staffing requirements, background numbers, schedules, character names, payroll, contractual requirements, safety, or legal compliance.
You remain responsible for decisions made using information displayed or generated by the app.
Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, revenues, or business opportunities. Our total liability for any claim is limited to the greater of US$50 or the amounts you paid to us for the app in the 12 months before the claim.
Indemnification
You agree to indemnify and hold us harmless from claims arising out of your content or your breach of these Terms or applicable law.
Termination
We may suspend or terminate your access for misuse, non-payment, or legal/regulatory reasons. You may stop using the app at any time and can delete it from your devices. If your subscription ends, Pro features (including CloudKit sharing) stop; data already in your iCloud remains until you remove it.
Third-party terms
Your use of iCloud/CloudKit is subject to Apple’s terms and policies. Network and roaming charges are your responsibility.
Changes
We may update these Terms. If we make material changes, we’ll notify you in-app or by another reasonable method and post the new effective date. Continued use after the effective date means you accept the changes.
Governing law & venue
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles.
To the extent permitted by applicable law, disputes arising from these Terms or your use of AD Background will be subject to the jurisdiction of the state or federal courts located in Georgia. Nothing in these Terms limits any non-waivable consumer rights or rights to bring a claim in another jurisdiction where applicable law requires otherwise.
Miscellaneous
Export compliance, severability, waiver, and entire agreement apply. If any part is unenforceable, the rest remains in effect. Feedback you provide may be used to improve the app without obligation to you.
